What is RICA?
Regulation of Interception of Communication and Provision of Communication-Related Information Act No. 70 of 2002 (“RICA”).
Why was it proposed?
RICA is a new legislation which is amongst others is intended: - to control cellular phone usage.
- curb organised crime
- to allow the law enforcement agents to intercept cellular phone communications if there is reasonable suspicion of crime.
- require cellular operators to keep detailed information of all their clients, as well as cellphones and SIM cards.
When is the effective date? The effective date has been withdrawn. Once promulgated all new customers will be required to register before a new SIM card is activated. Altech Autopage Cellular has 18 (eighteen months) from date the effective date to register all existing subscribers.
What is the purpose of RICA? To ensure: - registration of Cell phone handsets
- registration of SIM Cards
- registration of all SIM card and cellphone users in RSA
